Lawyers of incarcerated opposition strongman Dr Kizza Besigye and his political assistant Hajji Obed Kamulegeya Lutale are strategizing on how to counter Justice Emmanuel Baguma and the Director of Public Prosecution (DPP) Lino Anguzu’s next move concerning the forceful prosecution of their clients.
Justice Baguma of the Criminal Division of the High Court who is presiding over the treason related charges against the accused persons was expected to deliver his rulings on the two applications, one for bail and the other for stay of proceedings against the accused persons until the determination of their Constitutional reference filed at the Constitutional Court on Tuesday but he pushed it to Monday 29th December, 2025
During one of their strategy meetings, the lawyers were concerned that there is an intentional move to prepare for dismissal of both applications and immediately force the accused persons to take plea so that the trial kicks off.
“Even if Besigye declines to take plea and decides to keep quiet, the judge will record it as a plea of not guilty and will accept the disclosure from prosecution of evidence which they are going to base on when prosecuting him,” one of the lawyers explained to friends on what he thinks judge Baguma and the prosecution team led by Thomas Jatiko and Richard Birivumbuka are planning to do.
He further noted that both Baguma and the prosecution team think Besigye’s team have run out of options even if they delay.
He explained that even if Besigye withdraws legal instructions from the lawyers, state plans to provide them with lawyers paid by government to represent them even if they refuse to appear personally or on zoom.
However, other sources close to Justice Baguma told this website that he extended the delivering of the rulings because he wants to properly study the law and the environment so that on Monday, he ready for the case.
In the message to the people of Rukungiri and Kabale the home area of Dr Besigye through the speaker of parliament Thomas Tayebwa, President Museveni washed his hands clean insisting that he has no hand in delaying the prosecution of the accused persons as their supporters have been telling the public.
He insisted that Besigye and his co-accused will only be released from prison after the determination of their case noting that the prosecution is very ready for the trial even though Besigye and his lawyers are accusing the presiding judge of bias.
They even dragged him to Judicial Service Commission to be removed from the office of the judge.
