Kampala based lawyer Kassim Male Mabirizi has protested the move by judges of the Family Division of the High Court for what he termed as being blacklisted and stopped from presiding over cases he filed.

Mabirizi revealed that last week, he was informed by the Family Division of the High Court deputy registrar that all judges at the station declined to handle his family matter and Justice Margaret Mutonyi directed that his file be forwarded to Justice Stephen Mubiru the Mukono Resident Judge to handle.

Mabirizi said that the registrar informed him that Justice Mutonyi indicated that since the matter concerns the family of the late Muhamed Mutumba Bazinduse Lulibedda who was buried in Mukono district, Mukono Court is the rightful Court to handle the matter.

However, Mabirizi insisted that the High Court has the powers to handle all matters without limitation insisting that sending his file to Mukono is a tactic played by Family Division of the High Court judges to deny him fast and fair justice.

He added that even the contested properties in his father’s estate are located in Kampala city in the divisions of Lubaga, Kampala Central and Makindye.

He discosed that his file was first allocated to Justice Elizbeth Kabanda but he asked her to recuse himself accusing her of being biased.

It was then allocated to Justice John Eudes Keitirima but Mabirizi still asked him to recuse himself from the matter on the same grounds of biasness.

Mabirizi further petitioned Justice Dr Daglous Singiza’s Judicial Service Commission accusing Justice Keitirima of being incompetent and biased when he decided to determine his claim against his siblings who he accusses of forging their father’s will to exclude him as a child of the family.

As justice Keiritima was preparing his defence in the Judicial Service Commission, the file was allocated to Justice Celia Nagawa who with immediate effect ordered the registrar to give the file to another judge.

It was allocated to justice Immaculate Busingye who also declined to handle it wondering why they are giving him a controversial file when she is just a new judge at the station.

Sources at the Family Division of the High Court said that judges are scared of handing Mabirizi’s files because of his social media exploits while others are scared of granting his prayers in the matter including asking his father’s body to be exhumed so that a piece can be used in the DNA test of all his siblings.

Mabirizi wants to to establish whether he is a son of Mutumba or not. He insists that some of his siblings, especially the young ones, might not be his father’s children because they were produced when his father was weak and sick.

However, other siblings led by city self styled pastor Moses Male insist that Mabirizi is not their biological sibling.

They claim that he was just picked by their father who educated him and to become a lawyer.

However, Mabirizi claims that Male wants to use that claim to sideline him from benefiting from his father’s estate.
