Lawyers representing incarcerated controversial city lawyer Kassim Male Mabirizi have protested the move by the Director of Public Prosecution (DPP) Lino Anguzu to take over the private criminal prosecution he instituted against his family members who are sidelining him from benefiting from his father’s multibillion estate.
The development resulted from a letter signed by Caroline Mpumwire the Resident Senior State Attorney Mwanga II Chief Magistrate’s Court on behalf of the DPP showing interest to take over the criminal case against the accused persons
In a letter dated 17th February, 2026, presented to court by Gabriel Byamugisha, the lawyer of the accused persons asked the presiding magistrate to allow them to take over the criminal charges against his clients.
He noted that the law allows the DPP to takeover any private criminal prosecution against any person at any stage once he picks interest in the matter.
However, Mabirizi’s lawyers led by Yasin Ssentumbwe Munnagomba and Nasser Kibazo put up a spirited fight asking the presiding magistrate to first handling the issue of the accused person who are Stella Nalutaaya who is a step mother to their client and her daughter Janat Nantumbwe who is a sister.
“In the last appearance your warship, the accused persons lawyer who is present here assured this court that he was going to present the accused persons on this date so that they take plea on contempt of court charges. It is the reason why you did not issue criminal summons against them, but again he has come here empty handed without them which is a sign of disrespecting this court,” Ssentumbwe submitted.
In his response, Byamugisha told court that his clients are still sick but promised bring them even if in a wheel chair at the next hearing of the matter.
Mabirizi’s lawyers were advised not to come back to court next time because the matter will be taken over by the DPP.
In response, Ssentumbwe told court that since his client is incarcerated in Luzira prison, he needs time to consult him before responding to the said application of the DPP taking over his private criminal prosecution.
He however noted that the DPP taking over his matter is a scheme by to shield his client’s tormentors who are fighting him from benefiting from his father’s multibillion estate alleging that he is not his son.
Mabirizi is battling with his family members led by city pastor Solomon Moses Male over the estate of their father Muhammad Bazinduse Lulibedda Mutumba who died during the 2019 Covid-19 lockdown.
Justice David Matovu of the High Court directed all the children of the deceased to be subjected to DNA test to establish whether they are biological children of the late Mutumba.
However, pastor Male and other family members protested the decision insisting that they cannot subject themselves to DNA with a stranger like Mabirizi who they claim is not a son of their father.
Mabirizi on the other hand accused pastor Male of influencing other family members to turn against him because of the personal grudge he hold against his late mother Masitulla Mutumba because they were in the same age bracket.
He added that for a longtime, pastor Male and other family members have been challenging Court orders to subject them to a scientific examination through DNA because their main agenda was to sideline him and make sure that he doesn’t benefit from his father’s multibillion Estate.
Late Mutumba left behind a juicy Estate with a huge chunks of land in different parts of the country, apartments and rentals in areas of Lubaga Division, Nakawa and Central Division.
Mabirizi alleged that even before securing the letters of administration to manage the deceased’s estate, the accused persons had already started collecting money from the Estate.
Mabirizi claimed that pastor Male masterminded the forging of their father’s will and he is using this forged will to challenge his legitimacy as a son to the deceased.
However, the accused persons through their family lawyer Byamugisha denied all the allegations insisting that the deceased’s will was brought to the attention of family members and friends by a widow who informed them that the deceased is the one who asked him to keep it and produce it after his death.
Byamugisha who was already dragged to law council by Mabirizi over unprofessional law practice added that the said will which Mabirizi is challenging was read openly before the members of the family and friends and his name was not mentioned anywhere when the deceased was declaring the children he left behind.
He advised Mabirizi that instead of wasting his time in Court making his client waste their money, they should look for his family and settle the matter so that life moves on.
