Maverick State Minister in charge of lands in the Ministry of Lands Housing and Urban Development Dr Sam Mayanja and Senior Presidential Assistant on Special Duties Phiona Birungi have instructed Kampala’s prominent law firm the Kampala Associated Advocates (KAA) to challenge Kabaka Ronald Muwenda Mutebi’s recent Court victory over the ownership of Kaazi land in Wakiso district.
In his affidavit, Mayanja claimed that High Court judge Isaac Bonny Teko erred in law and fact when he allowed the proceedings of the matter against him and Birungi without the affidavit of service confirming that as respondents, they received Court summons.
Mayanja further claimed that after learning about the lawsuit, he personally wrote to the judge pleading with him to give him the opportunity to respond to the application filed by Kabaka and Buganda Land Board. However, he was shocked with the abusive actions of the presiding judge.
Mayanja wondered how a judge could look on as lawyers from Attorney General’s chambers and those from the Office of the Commissioner Land Registration consent with Kabaka’s lawyers to proceed in their absence even though they were already notified to be allowed to file their defense.
The minister also wants the judiciary authority, especially the Principal Judge, to pick interest into the matter and investigate the actions of the judge claiming that there might be a collusion to deny him and Birungi justice through fair hearing.
However, Mayanja faces a serious legal war with another top Kampala law firm of K&K Advocates which is owned by president Museveni’s son-in-law Edwin Karugire and Attorney General Kiryowa Kiwanuka.
Kabaka hired K&K Advocates to handle his sensitive cases and Usaam Ssebuufu was assigned to handle all matters in K&K Advocates that involve Kabaka Mutebi, Buganda Land Board and all legal issues concerning Buganda Kingdom.
Mayanja claims that the Kabaka is using a top government official to influence the judiciary to win controversial Court cases, insisting that judges who preside over this officials’ cases of interest have been rewarded with promotions.
However, this has website established that when Kiryowa Kiwanuka was appointed the Attorney General, he resigned as a founding patterner at K&K Advocates and he is no longer involved in running the law firm.
Mayanja also confirmed to this website that he has also resigned as a founding patterner at KAA Advocates since he was appointed a minister and is longer involved in the running of the law firm.
This website understands that there is a silent war between these two prominent law firms with one accusing the other of using their influence in the first family to fight their interests in juicy government deals including one of representing president Museveni in presidential election’s petitions.
