This mighty investigative website can exclusively report that Justice Emmanuel Baguma, the deputy head of the Criminal Division of the High Court, has surrendered one of the files for opposition strongman Dr Kizza Besigye and his political Assistant Hajji Obed Lutale Kamulegeya.
According to highly trusted sources, justice Baguma handed over Besigye’s file where his lawyers are seeking revision of the decision made by Nakawa Chief Magistrate Christine Nantege including committing the accused persons for trial in the High Court without the presence of their lawyers and continuing to hear their case yet they were already committed to the High Court.
The said file was given to the Division Court head Justice David Matovu to handle or to allocate it to another judge. Before Justice Baguma ordered that all files be given to him, the said file was allocated to Justice Issa Sserukuma.
According to Besigye lawyers, Baguma now has two files. In one, the accused persons are seeking for mandatory bail saying they spent more than six months on remand without trial and the second one is for their second bail application after Justice Rossette Comfort Kania denied them bail even though they had all the requirements.
Even though Besigye’s lawyers led by Kenyan senior lawyer Marth Karua and his opposition supporters have threatened to raid Principal Judge Dr Flavian Zeija’s chambers to demand for a date when Justice Baguma is going to hear their client’s application, the presiding judge is still defiant on fixing the date.
Last week, Justice Matovu promised Besigye’s lawyers and supporters that by Wednesday which is 23rd of this month, their matters will be fixed for hearing noting that Courts are still mourning the death of the law giant Justice George Wilson Kanyeihamba
It should be remembered that justice Baguma assured Besigye’s lawyers that he will not be forced to fix their matter.
He told them that he will fix it at his connivence which left his old boy at Kampala Education Centre who also doubles as the Kampala Lord Mayor Ssalongo Erias Lukwago fuming and wondering what happened to his longtime friend.
