Magistrate Summons More Court Of Appeal Judges As City Lawyers Dragged In Trouble…

Flamboyant Buganda Road Magistrate Winnie Nankya Jatiko has summoned another Court of Appeal Judge, fellow magistrate and officials from Kampala Capital City Authority (KCCA) to testify as defence witnesses in the case involving city dentists and a son of the former president of Uganda.

Flamboyant Buganda Road Magistrate Winnie Nankya Jatiko has summoned another Court of Appeal Judge, fellow magistrate and officials from Kampala Capital City Authority (KCCA) to testify as defence witnesses in the case involving city dentists and a son of the former president of Uganda.

The summons were issued days after Nankya dismissed the testimony of Dr Asa Mugenyi who is a judge of the Court of Appeal which is also doubles as the Constitutional Court who was brought by Dr Lule Ntwatwa to testify as his witness after Court found him having a case to answer in the criminal charges of giving false information to a person employed in public office, conspiracy to defraud and uttering false documents.

Before being appointed as a Court of Appeal judge, Justice Mugenyi was a personal lawyer to Dr Ntwatwa and he brought him to defend the documents he authored to avoid conviction but the testimony was dismissed

After losing the testimony of Justice Mugenyi, Dr Ntwatwa pleaded with Nankya to also summon Justice Margrate Tibulya and former Law Development Centre (LDC) Magistrate Martin Kirya to come and testify in his favour insisting that they have valuable evidences which will save him from prosecution.

He also pleaded to Court to summon KCCA officials to testify in his favour on the number of documents which were issued by the authority 1990 to 2018 to support his claim that he opened a Kiosk on Kibanja in 1992

Dr Ntwatwa who is operating a dental clinic along Lubaga road also confirmed to the presiding magistrate that he has dragged his lawyers Umal Nyanzi and Robert Ssenfuka to Pamela Lamunu the Chief registrar over allegations that they have been practicing law in the country without a practicing license

“Your worship, my lawyers today are not present because of the statement you made at the previous sitting of this court that my lawyers are not on the list of lawyers authorised to practice law in the country. I have written to the Chief Registrars to confirm from him whether they are practising legally because even though they showed me their practicing license, I was not convinced,” Dr Ntwatwa said

However, the presiding magistrate told him that she never directed him to question his lawyers but he only told him to inform them in time to appear before her with their practicing licenses because it is a practice in all courts of the country

The magistrate further declined to allow Ntwatwa’s prayer of allowing him also to take two years himself as it was with prosecution. He explained that his matter was forwarded to her in April 2024, when prosecution made their case, she made her ruling on the case to answer and is not two years as he claims

The magistrate assured Ntwatwa that she is ready to conclude his case before the end of the year noting that she is being paid taxpayers’ money to give justice and he should stop playing games with him because for him he wants the matter to spend another two years on court record pending.

Dr Ntwatwa a Dentist and resident of Aggrey Zone in Lubaga Division is jointly charged with Stuart Kateregga a self-employed resident of Munyonyo in Makindye Division and Wasswa Ntoogo, a resident of Soweto Zone in Katanga, Kawempe Division

He has produced defence witnesses who include Justice Mugenyi, Tour operator Stella Nassuuna, and Moses Karemire Besimira and Kateregga but their testimony was rejected on grounds that the documents they relied on where not certified by concerned authorities

State accuses the accused persons of giving false information to police officers regarding ownership of Kibanja on part of Katanga land at Mulago Round About with aim of grabbing it from city pastor Danial Walugembe

It is alleged that Dr Ntwatwa, Kateregga and Ntoogo and others still at large in the year 2019 at Wandegeya Police Station, Kawempe Division in the Kampala District gave information to Detective Corporal Lubowa employed at the Uganda Police force which they knew or believed to be false that they were the rightful owners of the Kibanja opposite Government Analytical Laboratory (GAL) Mulago Round about.

The false information was intended to make the said Police officer believe that the said Kibanja belonged to them so that he denotes time and energy to investigate the matter.

State alleges that between 2019 and 2020 in Kampala, the three suspects conspired to defraud Walugembe of his Kibanja opposite GAL at Mulago Round About Haji Kasule Road by claiming to have bought it from Bulasio Bwisi in the early 1990s.

According to the sheet, on September 17, 2020 at Wandegeya Police Station, Kawempe Division, knowingly and fraudulently uttered false documents to wit Busuulu receipts (Ground rent receipts) to the Police officer purporting to have been issued to him by the family of Ashe Sendawula Mukasa.
