Flamboyant city lawyer and also the founding partner of Muwema and Company Advocates Fred Muwema has assured his clients and the entire public that he will do everything necessary in his capacity with the help of other partners to obtain the appropriate legal redress.
In the statement issued after his law firm evicted from their offices on Plot 50 Windsor Crescent Road over a Shs1.4bn rent dispute with Downtown Investments Ltd, Muwema insists that whatever was done was illegal
He explains that as he struggles to secure justice, they are currently working remotely and are reachable through all their existing communication tools as they look for another place to call home.
The operation to evict Muwema from his offices was done after the decision of the Commercial Division of the High Court which allowed Downtown investments Ltd the landlords of the building to take possession and evict the tenants.
In his statement, Muwema stated that the operation to evict them was commanded by policemen and women from Kira Road police station together with unknown men who forced them out of their Kololo offices
“This was an illegal eviction disguised as a re-entry, a remedy which was no longer available to Downtown after it submitted the dispute with us, to the Courts. Most importantly this was an irregular execution by all accounts, of the recent judgment in HCCS No. 621 of 2023: Downtown Investments Ltd Vs M/s Muwema & Co. Advocates & 2 Others, which we have appealed,” the statement read in part.
He added that the fact of the matter is that the eviction was done in a bid to frustrate the appeal they filed in the court of appeal challenging the decision of the High Court
He insisted that the legal process of effecting an eviction was deliberately not followed. For example, no execution process of the court decree commenced, the 90-day notice of eviction required under the the Constitution, especially the land evictions practice directions of 2021 were not issued and no warrant of eviction was issued by the Court to be enforced by the police.
“We condemn these wanton criminal acts committed by Downtown Investments Ltd with the support of the police and will do everything necessary to obtain the appropriate legal redress,” the statement further read.
