Few weeks to his arrest, maverick city lawyer Kassim Male Mabirizi exclusively told this reporter that he had received intelligence that his close friend Richard Birivumbuka the Chief State Attorney in the Office of the Director of Public Prosecution (ODPP) was struggling to save him from being arrested and charged over statements he made on his social media platforms.
Mabirizi disclosed that he was told that police officers have been planning to arrest him accusing him of thinking that he is a fearless lawyer who speaks to authority and top government officials including President Museveni and his family without fear.
“The other time, I was saved by my friend Samuel Muyizzi from being arrested by a policeman at Kanyanya Chief Magistrates Court, because of annoying Sarah Sharon Nabunya the station’s court Chief State Attorney,” Male said.
He added that others accuse him of frustrating State’s plan to speed up the prosecution of the opposition strongman Dr Kizza Besigye, his political assistant Obed Kamulegeya and UPDF soldier Captain Denis Oola but all these plans were being frustrated by Birivumbuka.
Mabirizi confirmed that at Central Police Station Kampala, he recorded a statement concerning a complaint filed by Lino Anguzu the Director of Public Prosecution (DPP) accusing him of making forgeries and uttering false statement.
He insisted that for him and his lawyers, they are ready to faceoff with Birivumuka’s witnesses including Chief Justice Flavian Zeija, Justice Musa Ssekaana of the Court of Appeal and Anguzu who are the complainants.
“Let them do whatever they want, I will expose all of them because I’m ready to meet them in the witnesses dock while defending myself against their complaints,” Mabirizi boasted as entered Luzira prisons bus.
According to the charge sheet, Mabirizi is accused of making malicious statements against the Chief Justice who he accused of being a con man, fraudster and corrupt.
He also alleged that he sold off his property to pay a bribe for his appointment as a Principal Judge of Uganda.
Mabirizi is further accused of making hate speech against justice Ssekaana who he called a fraudster and a con man which was likely to ridicule, degrade or demean him before well thinking members of the public.
This is the second time Mabirizi is being imprisoned on charges related to Justice Ssekaana. In 2022, Justice Ssekaana himself sentenced Mabirizi to 18 months imprisonment on contempt of court.
