Mityana RDC Punished With Shs25m Fine Over Abuse Of Office, Fueling Fraud…

Justice Tadeo Asiimwe the Mubende Resident Judge has directed Proscovia Mwanjuzi the Mityana district Resident District Commissioner (RDC) to compensate a businessman with Shs25m with interest because of the fraudulent deals she executed against him by abusing her powers as a government official.

Justice Tadeo Asiimwe the Mubende Resident Judge has directed Proscovia Mwanjuzi the Mityana district Resident District Commissioner (RDC) to compensate a businessman with Shs25m with interest because of the fraudulent deals she executed against him by abusing her powers as a government official.

In his ruling, the presiding judge through his comprehension of the interpretation of the application established that Mwanjuzi did not have the mandate of carrying on the duties of hearing the complaint resulting from a contestation on a building since she is not a Court.

“In this case the Deputy RDC did not have any mandate to determine rights of the parties and make declarations as she did. Even the procedure adopted was flawed and did not reflect the tenements of fair hearing,” the judge stated

The judge noted that the RDC who didn’t defend herself on the application against her violated article 28 of the Ugandan constitution which guarantees the right to fair hearing when she abused her powers by chairing a meeting and making several declaration including changing the ownership of the building.

He noted that it was wrong for the RDC to issue orders in writing over the house directing tenants to stop dealing with Kalembe and directing that all their rents and other obligations be given to Gayi.

The judge further issued the order of prohibition against Mwanjuzi and her agents from implementing the decision she made against Kalembe.

He also issued a permanent injunction against Mwanjuzi from interfering with Kalembe’s building and ordered her to pay general damages of Shs10m, punitive damages of shs15m with interest of 10% from the date when the ruling was made till payment in full and costs of the case.

According to court records, since 2006,  Kalembe has been the rightful owner of the commercial building in Zigoti, Mityana district.

He told Court that he bought the building from UML now Equity bank but was shocked in August 2025, when Mwanjuzi come with Gayi and declared him the owner of the building without giving him a fair hearing to defend himself.
