This Investigative news website can exclusively report that the Kabaka of Buganda Ronald Muwenda Mutebi has agreed with the findings and decisions of the judges at the Kingdom’s culture Court (Kkooti ya Kisekwa) and dismissed Yusuf Ntege Mbirozankya as the Ffumbe clan head.
In their judgement, the former judges of Kkooti ya Kisekwa led by Joseph Katerega the chairperson of the court, Lubega Sserembe, Deogracious Kasozi, Salim Makera, Wilson Ssentogo and Jamil Ssewanyana as members in 2024 dismissed Mbirozankya as the Ffumbe clan head.
The judges agree with the evidence and submissions brought by the complainants that Mbirozankya is not fit to be their clan leader because he is from Omutuba gwa Ssabalangira Kasolo where clan heads are not supposed to come from.
They rubbished Mbirozankya’s defense that their great grandfather Omutaka Kisitu Ntege Walusimbi produced more than 15 children from who the persons to be enthroned as Ffumbe clan head has to come from, revealing that Omutaka Walusimbi only left behind 4 children.
Judges based their evidence from the books written by Buganda historian like ‘Amanya amaganda n’ennonno zago’ written by MB Nsimbi, ‘Ebika by’Abaganda’ written by Sir Apollo Kaggwa, the former Buganda Kingdom Premier which all confirm that Walusimbi produced only 4 children as the complaints told court not more that 15 as the defence claims.
The children are Nagalya, Magunda, Ssempala and Nnaku who is the only daughter. He concluded that the person who takes over the clan leadership should be from the Nagalya lineage.
The judges noted with suspicion that lawyers who drafted and confirmed the 2014 Ffumbe clan constitution misled the clan members on where to pick the clan heads from.
Court also overruled Mbirozankya on his preliminary objection that Kkooti ya Kisekwa doesn’t have powers to determine his legality as a clan head basing on the order issued by Kabaka Mutebi.
Court accuses Mbirozankya of misinterpreting Kabaka’s directive explaining that what Kabaka stopped was clan members prosecuting their clan head in their clan court noting that Kkooti ya Kisekwa was mandated to handle all culture issues concerning the legalities of clan heads.
After losing, Mbirozankya decided to appeal to Kabaka who is the supreme and final decision maker on Buganda cultural issues but highly placed sources in Kabaka’s office confirm that Mbirozankya has lost again.
The source said that after writing his decision, Kabaka summoned Ffumbe clan heads led by former Buganda Kingdom Premier Owekitiibwa JB Walusimbi and directed them to look for a suitable person who will act as the acting clan head as the process of looking for the right clan head is done and they have already started the process of executing the Kabaka’s directives.
He said that Walusimbi’s team is Stuck because the person they chose, a one Mbwateyeewoola, who led the complaint against Mbirozankya was arrested and imprisoned on charges related to aggravated robbery.
The source added that with immediate effect, Kabaka directed that Mbirozankya’s name and photo should stop appearing in any Kingdom official documents and it is the reason why his name and photo was not included in the official booklet Gambuze which contained the birthday messages from clan heads to Kabaka who was celebrating his 70th birthday early this month.
He said that Mbirozankya was not even given an invitation card to attend the official celebrations at Lubaga Cathedral even though other members of his clan executive were given invitation cards.
“The Kabaka is very bitter with Mbirozankya, that’s all I can tell you,” the source said.
When contacted, Omutaka Ssalongo Augustine Kizito Mutumba the Buganda Kingdom clan heads council speaker and also the Kkobe clan head said that he has not yet officially received the communication from Kabaka over Mbirozankya’s judgement.
He explained that when the judgement is publicly issued, he will comment because it will be a public document.
Mbirozankya also told us that he has not yet received his copy even though he was also tipped that he lost the appeal noting that he will accept the decision from the King as he plans his next move.
Mbirozankya led fellow clan heads to meet president Museveni at State House Entebbe and asked him for a piece of land which he bought to them at Shs9.5bn. The land is situated at Mengo a Kampala suburb.
He was also in the middle facilitating clan heads to travel to Namibia without the permission of the Kingdom leadership to met the Kabaka who was getting medication. Kabaka’s prayer to stay in Namibia was not extended and he was told to return back to his Kingdom to avoid his subjects who were demonstrating at all their embassy claiming that their government had abducted their cultural leader.
Mbirozankya is also accused of secretly mobilizing fellow clan heads to impeach their speaker Mutumba on grounds that he betrayed them by conniving with Buganda Premier Charles Peter Mayiga to stop them from accessing their boss Kabaka Mutebi.
He said that Kabaka was bitter with Mbirozankya’s actions and he wanted to punish him so that others can learn that Buganda Kingdom has leadership that guides the running of the Kingdom and clan heads are not part of the fundamental pillars.
However, this website has established that Mbirozankya is planning to challenge Kabaka’s decision in the High Court claiming that it was done out of bias against him to favour the complainants who wanted to grab his clan land.
There is also fear that Kabaka’s decision is going to divide one of the largest clans in the Kingdom because Mbirozankya is likely to move with his grandchildren who recognises him as their clan head as it is in ekima clan, ennyonyi and ngabi clan.
