Self-exiled Supreme Court Justice Dr Easther Kitimbo Kisakye’s legal war against the Chief Justice Owiny Dollo, Attorney General Kiryowa Kiwanuka, Judiciary’s Permanent Secretary Pius Bigirimana, Justice Dagalaus Singiza’s Judicial Service Commission kicks-off next month after the retirement of the Deputy Chief Justice and head of the Constitutional Court which also doubles as the Court of Appeal, Justice Richard Butera.

Justice Kisakye’s lawyers led by Constitutional law giant Peter Walubiri have been pleading to Justice Butera to fix their Constitutional petition against the respondent but they allege he has turned a deaf ear until Dr Flavian Zeija replaced him early this year and their matter was fix for conference on 15th May, 2025.

The Court is going to first handle the application filed by maverick city lawyer Kassim Male Mabirizi who is pleading to be added on the petition as a party claiming that he is also aggrieved and his Constitutional rights were violated in the acts which resulted in the petition.

Justice Kisakye petitioned the Constitutional Court seeking a declaration that she was illegally subjected to Judicial Service Commission disciplinary action and that the CJ violated her constitutional right as a justice of the Supreme Court when he confiscated her files containing the rulings and the 2021 presidential elections petitions against the winner President Museveni, denying her case files to handle and denying her salary and other allowances

Museveni’s win was being challenged by National Unity Platform’s presidential candidate Robert Kyagulanyi Ssentamu (Bobi Wine).

In his application, Mabirizi claims that Justice Dollo made a grave allegation in his complaint before the Judicial Service Commission and in his defence in the said petition against him claiming that during the days of his fight with Justice Kisakye at the Supreme Court, she was in frequent talks through phone calls with him which he denied.

He added that since 2021, he has never received the ruling from Justice Kisakye where he was seeking Justice Dollo’s recusal from the presidential election petition claiming that before appointed a Justice of the Supreme Court, he was a personal lawyer to President Museveni who was a party in the matter before him.

Mabirizi further claimed that because of the fight between Justice Kisakye and Dollo, his rights were violated when he was denied access to the Supreme Court over claims that he was going to talk to Justice Kisakye and advise her on how to fight Dollo and other supreme Court justices.

The development comes at a time when President Museveni has already appointed a tribunal to probe Justice Kisakye’s actions.

The President wants advice on the next course of action after the Judicial Service Commission recommended that she be dismissed from the Judiciary with disgrace.
