Lawyers representing controversial city lawyer Male Mabirizi are back on the drawing board after Buganda Road Chief Magistrate Ritah Kidasa Wanyama declined to release him on court bail citing irregularities in the accused person’s identification details and those of his sureties.

In her ruling, Kidasa noted that all the four sureties presented expired national identity cards and failed to provide evidence confirming to court that they have applied for renewal of their IDs.

The magistrate further stated that the accused person also failed to provide court with his national identity card and only produced his NIN.

Basing on these grounds, she dismissed the application and adjourned the matter to 20th March, 2026.

Lawyers representing the accused person led by Anthony Asiimwe the vice president of the Uganda Law Society put up a spirited legal fight and asked the trial magistrate to stay the proceedings of the criminal trial noting that the trial cannot proceed when the law which it stemmed from which is the Computer Misuse Act is being challenged before the Constitutional Court.

As lawyers argued the application after the dismissal of his bail application, Mabirizi raised his hand and told the magistrate that before they proceed with anything she should recuse herself from his trial insisting that he does not expect any justice from her.

The magistrate tried to explain to Mabirizi that he should pass his prayers through his lawyers but he insisted that the matter he was raising affects him as a person and the magistrate herself understands very well their troubles.

The magistrate became furious and adjourned the matter as Mabirizi hurled words at her to resign from the judiciary if she cannot give justice to citizens who are her bosses.

He explained that from the day he was arraign before her, he asked her to rescue herself from his matter on grounds that he filed a complaint at the Judicial Service Commission against her.

Ono Bwino has established that after a long discussion, Mabirizi and his lawyers agreed to go back to Kidasa by filing documents which show that all the sureties applied to renewal their national identity cards and also provide the accussed person’s original national identity card.

This reporter has also learnt that lawyers representing Mabirizi  are also planning to file another bail application at the Criminal Division of the High Court and the Human Rights Enforcement application.

The development comes at a time when prosecution assured court that investigations into the criminal file are nearing completion.

This website has also learnt that among the witnesses who State plans to start with to testify against Mabirizi is Justice Musa Ssekaana the judge of the Court of Appeal which also doubles as the Constitutional Court.

Sources said that Justice Ssekaana who is among the complaints against Mabirizi recorded a statement with police and assured the investigators that he will testify even though the Chief Justice Dr Flavian Zeija who is the other complainant declined to record a statement at Kampala Metropolitan police headquarters.

Mabirizi is facing charges related to Computer Misuse. He is accused of making statements of hate speech against the person of Ssekaana and Zeija.

“I’m very ready to face Ssekaana myself, I will cross-examine him and he will be exposed,” Mabirizi boasted.
