This investigative website can exclusively report that before the end of this week, Jordon Ssebuliba Kiwanuka will kick off the process of executing the orders issued by Justices of the Court of Appeal led by Justice Cheborion Barishaki, Justice Christopher Gabashirabeke and Justice Dr Asa Mugenyi before 30 days expire.
The Justices directed Ssebuliba to use these 30 days to convene a family meeting comprising of his father tycoon Mohan Musisi Kiwanuka’s lineal descendants and wives to appoint individuals who will manage the estate of their father.
If they fail court will use its powers to appoint a person it deems fit to manage the multibillion estate.
Highly placed sources in Mzee Kiwanuka’s family revealed to this website that Ssebuliba is drafting a short letter which he is going to send to everyone who is supposed to attend the meeting including president Museveni’s former Minister of Finance, Planning and Economic Development Maria Nabasirye Kiwanuka who is the second wife to the tycoon and her two children.
Ssebuliba will also summon his mother Beatrice Kavuma Luyiga Kiwanuka and her three children, his aunties Jalia Muwanga, Yudaya Nantege Nsereko, Barti Nsereko Kawooya and Sarah Nsereko and other vital family members.
Family members have told this website that they plan to host the meeting at Sebuliba’s mother’s home or one of the top hotels in the city if the agitators ask for a natural ground.
Ssebuliba is also thinking of getting a senior citizen who is a close friend to his family to chair the meeting and so far he has zeroed on Prince Dr Kassim Nakibinge Kakungulu the Muslim titular leader or Al-Hajji professor Twaha Kawaasi the first Buganda Kingdom Prime Minister to help him in executing the orders of court.
In this meeting Maria and her children who have been administering the estate of the tycoon will give account on how they have been running the multibillion estate since 2017.
They will have to provide among other things; the list of assets being disposed off, rental income, sales and loans, mortgages and after receiving all the books of account since that period. Once they are submitted, the new administrator will submit them to certified auditors for verifications.
Concerning the continued managing of the tycoon’s health, Maria and her children will provide all the documents showing how he has been receiving medication locally and abroad since 2017.
After that, they will appoint a person who will be responsible for taking care of his day to day health conditions instead of leaving Maria alone to handle him when she has other personal and family issues to handle.
Sources said that Kiwanuka and his lawyers are expected to report back to Court with the report on how they have executed the orders before the end of this month even though this website has established that Maria and her lawyers led by Francis Buwule of Buwule Mayiga and Company Advocates are strategizing on how to appeal against the landmark judgement.
However, they will be perturbed by the legal blocks the justices of the Court of Appeal put in their way given the fact that they declared the tycoon of unsound mind, which means he cannot give instructions to proceed with their appeal.
“Maria is really in a tricky situation because she was disappointed with the judgement. But if she refuses to honour the orders, she will be charged with contempt of court and she can be imprisoned. The best option is to amend her relationship with other family members,” a family member said.
The justices also placed Maria’s lawyers in a tricky situation since they implored the Uganda Law Council to pick interest and take disciplinary action against Maria’s lawyers especially Francis Buwule whom they accused of violating the advocates’ code of conduct.
“Before we take leave of this matter, we again note, with concern, the dishonourable conduct of an advocate of the court of judicature of Uganda appearing as an advocate in a very contentious matter as this one which he had already sworn an affidavit in reply. What is evidently more concerning is that this is the same advocate who, in July 2023, appeared in the High Court and admitted that the person on whose behalf he was appearing suffers from a mental disability,” the Justices stated.
They added that the actions of Buwule, a senior law firm partner to Buganda Premier Charles Peter Mayiga cast a lot of doubt regarding the continued existence or legality of the advocate’s instructions.
“We would think that this is a matter in which the Law Council should be deeply interested to confirm the factual existence and legality of those instructions. It is possible, but doubtful, that a person whose own advocate admits suffers from mental disability would have been able to properly instruct that advocate or any other advocate on that matter.”
They added that, “The Law Council is best suited to investigate the instructions of the advocates who appeared for the Respondent (who are Buwule and senior council Dr Faisal Mukasa of Fides Legal Advocates) in this application in order to ascertain the existence, legality, scope and propriety of those instructions in view of the Respondent’s admitted mental state especially if such representation has caused harm to his claimed client,” the Justices stated.
The Justices further exposed Buwule accussing him of telling Court lies when on record he assured Court that Kiwanuka gave his wife Maria and her two children powers of attorney to run his estate well knowing that the man has another wife and children which court confirmed.
Buwule was further blasted for accussing Kiwanuka’s biological son of plotting to grab his father’s estate and petitioning Court in the matter yet the son was trying to save his father’s estate.
They wondered how a hired lawyer could have more attachment to his client than his biological son. They advised him to reflect on how he is practising his legal duties.
The Justices were also not happy with their colleague at the Court of Appeal, Justice Musa Ssekaana who handled the matter at the High Court.
They accused him of hiding the facts of Court when he moved on a locus visit to Tulip Hotel where he met the tycoon in the presence of the lawyers from both sides for 30 minutes and after directed lawyers to excuse themselves from the meeting so that he could talk to the tycoon for another 15 minutes.
After, he based on this ground to declares give his ruling.
The Justices also explained that Justice Ssekaana erred in law and fact on that matter because on record, there was evidence produced by Dr Farook Maniyar, a United Kingdom celebrated medical doctor who is also a personal doctor to the tycoon stating that when he examined the tycoon in 2017, he discovered that he was starting to loss his memory.
This was confirmed by another medical doctor Dr Muhammad Kasasa Buwule who was a relative to the tycoon and Ssebuliba himself.
It is not clear whether Maria will leave Ssebuliba to run his father’s companies which include; Radio one, Akaboozi kubiiri, Oscar industries limited, Kiwatule Estate, Bwerenga Estate, Metro Services Limited, Starways Limited, Summit Estate Limited and other pieces of land which are more than 100 in Kampala Leafy areas of Kololo, Nakasero and Naguru which are worth billions of money.
